1. Acceptance of Terms
By accessing or using the BytesFlows platform ("Service"), accessible from https://bytesflows.com, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.
2. Accounts and Registration
To access certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
You are responsible for safeguarding your password. You agree to not disclose your password to any third party and to take sole responsibility for any activities or actions under your account, whether or not you have authorized such activities or actions.
3. Usage Guidelines
You agree not to use the Service for any purpose that is illegal or prohibited by these Terms.
- Prohibited Activities: You may not use the Service to engage in any illegal activities, including but not limited to fraud, spamming, hacking, or distribution of malware.
- Abuse: You may not interfere with or disrupt the integrity or performance of the Service or the data contained therein.
BytesFlows reserves the right to terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
4. Payment and Refunds
Self-serve plans are billed as auto-renewing subscriptions unless a specific offer states otherwise. Each billing cycle credits the traffic allowance included in your plan. Unused traffic does not roll over. You agree to pay all fees associated with your use of the Service.
Payments may be processed by Paddle as Merchant of Record. Refunds, cancellations, and related consumer rights are described in our Refund Policy, and purchases processed through Paddle are also subject to Paddle's Buyer Terms and Buyer Refund Policy, including any mandatory consumer rights that apply in your jurisdiction.
Except where required by applicable law or by the Refund Policy / Paddle's policies, consumed proxy traffic is generally non-refundable. We do not offer refunds solely for change of mind or for incompatibility with a specific, non-guaranteed target site unless explicitly stated in a written Service Level Agreement (SLA).
5. Intellectual Property
The Service and its original content (excluding Content provided by you or other users), features, and functionality are and will remain the exclusive property of BytesFlows and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.
6. Limitation of Liability
In no event shall BytesFlows, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.
7. Governing Law
These Terms shall be governed and construed in accordance with the laws of Singapore, without regard to its conflict of law provisions.
8. Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will use reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
